Racially discriminatory legislation

Nine racially discriminatory laws, mainly towards Israeli Arab citizens, were introduced in the Knesset during the relevant time period for the report, 1.3.2014 to 28.2.2015. It should be mentioned that there were about 6 months during this period when there was no parliamentarian activity, the three months of Operation Protective Edge and between December 2014 and February 28, 2015 when the Knesset was dissolved for the elections. In fact, some of the bills were introduced in the 18th Knesset and were promoted through the 19th Knesset that operated only for half of its assigned time. All of these racist bills are accompanied by a campaign of incitement seemingly meant to clarify them for the general public, yet actually promoting the individual Knesset member who initiated the bill. Five of these bills are directly aimed to worsen the state of the Arab population while the other four of them benefit certain groups of the public at the expense of others.

Racial discrimination among elected officials and opinion leaders

Seven events of racial incitement are documented in the current report, four of them directed against Arabs, one against Mizrahim and two against refugees and migrants. The cases in this chapter do not include similar cases that occurred during Operation Protective Edge or during the election campaign (since the Knesset dissolved in December 2014), though it is clear that many such cases are documented throughout these two periods. A low number of cases occurred during half of the time this report covers, that is 6 months, while according to the data, the number of incitements among public figures that accompanied the war and the elections for the 20th Knesset was much higher.

 

Racism among citizens

Sixty-six racist events occurred among citizens or for which citizens were responsible, 51 directed against Arab citizens, 3 against Jews, 7 against Ethiopians and 5 against refugees and migrants. It should be mentioned that dozens of such events are not included in this chapter, but in the special report on racism during Operation Protective Edge, covering July-August 2014. Therefore, when the events documented in this chapter and those in the similar chapter of the war report are added together, they reach over 120 events during the relevant year. This means that we collected an almost equal number of events compressed into the two months of the war as during the remaining 10 months of the year (66 events during Operation Protective Edge and 62 throughout the rest of the year).

 

A special report on racism during Protective Edge war

Sixty-five acts of racial discrimination, mainly among citizens, are documented in the report.  In addition, 1500 Arabs were detained as a result of the demonstrations held by the Arab population during Operation Protective Edge. Fifty-five out of the sixty-five acts were committed by Jews against Arabs. It is safe to state that the number of injured is higher than the number of events, since most had multiple participants, whether in street physical violence or employee dismissals and harassments including physical assaults. The remaining ten events were committed by Arab citizens against Jewish citizens, including racial incitement and physical attacks.

The issue of police violence against the Arab public during the relevant period is not included in this chapter, but in the chapter regarding the security forces, yet the data about arrests show that during the previously mentioned two months about 1500 citizens were arrested, with 650 of them being criminally charged. A total of 350 cases, that is 20% of all the arrests made during July-August 2014, ended with indictments.

 

Racism during the 2015 elections

Twenty-four events were documented during the 20th Knesset election campaign, beginning with the 19th Knesset dissolving in the middle of December 2014 and ending with the elections in the middle of March 2014. These mainly include racial incitement by the candidates, whether through direct remarks, videos or other campaign means.  Eighteen of these events were directed against the Arab population, 4 against Mizrahim and 2 against refugees and migrants. It should be noted that the number of incitement incidents by public figures during the three months of the elections is higher than the total of events in the remaining year, that is the remaining nine months including Operation Protective Edge.

 

Acts of racial discrimination by the security forces

Sixty-six events of police violence are documented in this report. Out of all the documented cases, 55 were against Arab citizens and 11 were towards Ethiopians. This data includes only a small number of violent events towards the Arab public during Operation Protective Edge, presumably since many cases were not documented. The data concerning police violence victims are not compatible with the number of detainees. The accepted data are 1500 citizens arrested during the extremely violent two months of the war, during the Arab public protests against the war. In light of this existing number and after a check done with the Department for Police Investigation covering a short period of the relevant time, it appears that 65% of the accusations made by citizens in the year 2014 were not examined by the Department for Police Investigation. Out of the 1500 cases examined, about 200 led to trial (116 criminal trials and 104 disciplinary trials), and of the 116 criminal trials, 24 ended with the acquittal of the officer, either through a plea bargain or by dismissal of the charges. Only 92 cases (that is, about 2% of the total of 4500 complaints presented to the Department for Police Investigation) ended with the criminal convictions of the police officers.
